Bill Summary

S2341, the "Ensuring Safe and Toxic-Free Foods Act of 2025", overhauls how the FDA regulates substances that manufacturers self-certify as "Generally Recognized As Safe" (GRAS). Currently, companies can add new food chemicals without ever notifying the FDA. This bill requires manufacturers to submit detailed safety documentation, including cancer, reproductive, and developmental toxicity data, before a substance can be marketed as GRAS, and gives the FDA authority to object if the evidence is incomplete or an expert reviewer has a conflict of interest. All submissions and FDA decisions must be published publicly with a 60-day comment period. The bill also excludes carcinogenic substances and those with reproductive or developmental toxicity from ever qualifying as GRAS, and requires the FDA to reassess at least 10 existing food substances every three years. The changes take effect two years after enactment.

Why It Matters to MAHA

This bill directly advances MAHA's core mission by strengthening transparency in food safety and removing regulatory loopholes that have allowed potentially harmful additives to remain in the food supply without rigorous scientific scrutiny. The GRAS system has historically allowed manufacturers to self-certify additives as safe with minimal FDA oversight, undermining consumer health freedom by denying Americans informed choice about what enters their bodies. By requiring companies to submit real safety data, publish it publicly, and undergo regular reassessment, this bill brings scientific scrutiny to food additive approval, so consumers can finally know what's really in their food. It also stops industry-funded experts from rubber-stamping their own company's ingredients, closing a conflict-of-interest loophole that's let questionable additives slide through unchecked.
